Price basis: Broadcasting station rate 2009: The general terms and conditions of SevenOne Media GmbH apply. This can be downloadedunder the menu option Rate Cards/STC. The advertiser can book a sponsoring package at a fixed price or with flexible pricing. Flexible prices mean that there may be price corrections that take effect during the current calendar year either upwards or downwards in favour or at the cost of the advertiser. SevenOne Media will inform the sponsor of that type of price change. Such price changes are not a basis for extraordinary cancellation for the advertiser if the sponsor decides in favour of the flexible price model. When booking, the price model must be specified by the advertiser in writing and in a binding form. If no comment is found on the booking, then SevenOne Media shall proceed on the assumption of an agreement for fixed sponsoring prices.
In special cases SevenOne Media reserves the right, with prior notification, to exclude certain programs subsequently from any day sponsoring package after such a day sponsoring package has been booked.
The feature film sponsoring package includes public holiday programming. In special cases SevenOne Media reserves the right, with prior notification, to exclude certain programs subsequently from the sponsoring package booked; this affects topical formats and/or event programming in particular.
The broadcasting station is entitled to interrupt a booked stretch of programmes of two or more sequential broadcasts with other types of broadcasts. This can be booked by another sponsoring client. The offer is subject to the following condition: sponsoring clients who book the offer over the entire time period and/or multiple offer modules have priority over sponsoring clients who only want a partial booking.
After receipt of the sponsoring booking order or in the event of multiple bookings after the booking deadline set by SevenOne Media, SevenOne Media has up to 10 workdays as a decision making time limit for the order confirmation. If, in a sponsored show, there is also the possibility of category sponsoring, then this can be sold to another advertiser taking into consideration the non-competition exclusion according to the Nielsen Media Research Family.
SevenOne Media reserves the right to offer additional forms of advertising in sponsored formats to other advertisers, subject to the following conditions.
[1] In the case of sponsoring placements with a lead-time of longer than 6 weeks prior to broadcasting, the special forms of advertising within the sponsored format [Final Credits Split, Program Split, Cut In and TV Flash ] will initially be offered to the sponsoring client. The sponsoring client must decide by the 6 week deadline prior to broadcasting, whether and which of the special forms of advertising it wishes to book. Should the sponsoring client not avail itself of this option, SevenOne Media may sell the option to other advertisers, subject to the exclusivity stipulation as defined according to Nielsen Media Research Family data. [2] In the case of sponsoring placements with a lead-time of less than 6 weeks prior to broadcasting in formats scheduled at short notice, [definition: the offer was first communicated by SevenOne Media within the 6-week lead-time prior to broadcasting] the special forms of advertising within the sponsored format [Final Credits Split, Program Split, Cut In and TV Flash] will initially be offered to the sponsoring client. The latter must book any special forms of advertising required within the sponsored format [Final Credits Split, Program Split, Cut In and TV Flash] immediately. Should the sponsoring client not avail itself of this option, SevenOne Media may sell the option to other advertisers, subject to the exclusivity stipulation as defined according to Nielsen Media Research Family data.
[3] In the case of sponsoring placements booked within 6 weeks of broadcasting for formats, which SevenOne Media was offering for longer than six weeks prior to broadcasting, only the special forms of advertising within the sponsored format [Final Credits Split, Program Split, Cut In and TV Flash] that have not been booked by other advertisers will initially be offered to the sponsoring client, subject to paragraph 4. The latter must book any special forms of advertising required within the sponsored format [Final Credits Split, Program Split, Cut In and TV Flash] immediately. Should the sponsor not avail itself of this option, SevenOne Media may sell the option, subject to the exclusivity stipulation as defined according to Nielsen Media Research Family data. If and insofar as a sponsoring client’s placement also includes a period for the broadcast of the format, where the placement lead-time of more than 6 weeks prior to broadcasting is retained per Paragraph 3, Clause 1, Paragraph [1] applies as appropriate to these special forms of advertising.
[4] When booking a program sponsoring package in an environment where no Pre-, Move- and/or Trailer Splits have been firmly booked, the sponsoring client will be granted exclusivity for these special forms of advertising as per Nielsen Research Family data from the time of the booking.
[5] The above-mentioned Paragraphs [1] – [4] do not apply when booking a “Block Sponsoring” or a “Day Sponsoring” package.
Any sponsoring agreement shall be concluded subject to the approval of the TV channel. In addition to media costs, the sponsoring client shall bear the costs incurred in producing sponsor references. This is subject to printing mistakes and changes to the programme schedule. This is also subject to fee and licensing agreements with the broadcasting station as well as legal and editorial release of the broadcasting tapes that are produced. SevenOne Media reserves the right to place the sponsoring reminder before or after the interrupting block of advertising.
The sponsoring client shall supply two suitable language versions or a neutral version. Motif changes are possible on a weekly basis. Tape delivery: at least 10 days before the broadcast.
Binding information on which product the sponsor will use is required for a binding booking of sponsoring. A subsequent change of product for the same conditions is not possible. In particular, competition protection can no longer be guaranteed.
Exclusively the written booking is valid. The booking cannot be cancelled. A reservation and right of first negotiation cannot be granted.
